Welcome to BoutCoach. By accessing or using boutcoach.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will update the effective date at the top of this document when changes are made.

BoutCoach is an AI-powered fencing analysis tool that allows users to upload fencing bout videos and receive automated, phrase-by-phrase coaching feedback. The Service is currently offered as a free private beta and is subject to usage limits. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service and that your parent or guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

You agree to use BoutCoach only for lawful purposes and in accordance with these Terms. You agree not to: • Upload videos that you do not have the right to share or analyze • Upload videos containing content that is obscene, harmful, threatening, harassing, or otherwise objectionable • Attempt to circumvent any usage limits, access controls, or security features of the Service • Use automated tools, bots, or scripts to access or interact with the Service • Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Service • Use the Service in any way that could damage, disable, or impair the Service or interfere with other users • Resell, sublicense, or commercially exploit the Service or analysis outputs without our written permission We reserve the right to suspend or terminate access for any user we determine, in our sole discretion, to be in violation of these Terms.

You retain all ownership rights to the videos and content you submit to the Service ("Your Content"). By submitting content, you represent and warrant that: • You own Your Content or have the necessary rights, licenses, and permissions to use and submit it • Your Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party • You have obtained the consent of any individuals who appear in the videos, where required by applicable law By submitting Your Content for analysis, you grant BoutCoach a limited, non-exclusive license to process that content for the sole purpose of providing the analysis you requested. We do not store, retain, or use Your Content for any other purpose.

The coaching feedback provided by BoutCoach is generated by artificial intelligence and is intended for informational and educational purposes only. It does not constitute professional coaching, athletic training advice, or any form of certified instruction. AI-generated analysis may contain errors, omissions, or inaccuracies. You should not rely solely on BoutCoach feedback when making decisions about training, competition strategy, or athletic performance. We strongly encourage you to work with qualified coaches and trainers in addition to using this Service. BoutCoach makes no representations or warranties regarding the accuracy, completeness, or fitness for a particular purpose of any analysis output.

BoutCoach is currently offered as a private beta. As a beta service, it is provided "as is" and may be subject to bugs, interruptions, or significant changes. Features available during the beta period may be modified, restricted, or removed in future versions of the Service. During the beta period, use of the Service is limited to a set number of analyses per user. We reserve the right to adjust these limits at any time.

All content, software, technology, designs, and materials comprising the Service — excluding Your Content — are owned by or licensed to BoutCoach and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it as described herein. The BoutCoach name, logo, and any associated marks are trademarks of BoutCoach. You may not use them without our prior written consent.

Your use of the Service is also governed by our Privacy Policy, available at boutcoach.com/privacy. By using the Service, you acknowledge that you have read and understood our Privacy Policy. In the event of a conflict between these Terms and the Privacy Policy with respect to data handling, the Privacy Policy controls.

The Service relies on third-party providers to deliver certain functionality, including AI analysis and product analytics. These providers operate under their own terms and privacy policies. BoutCoach is not responsible for the practices of any third-party service providers. Links to third-party websites or services, if any, are provided for convenience only. We do not endorse and are not responsible for the content or practices of any third-party sites.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BOUTCOACH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BOUTCOACH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOUTCOACH AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL BOUTCOACH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100). Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless BoutCoach and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights, including any intellectual property or privacy rights.

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abuse of the Service, or discontinuation of the beta program. Upon termination, all rights granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
